A deadly crash involving a stolen car driven by a 13-year-old is putting Maryland’s juvenile justice system back under scrutiny.

Police say William Vance Payne II, 58, a father of five, was killed this past Tuesday morning in Germantown when a stolen Kia Optima driven by a 13-year-old boy crashed into his vehicle as Payne was heading to work.

Seven children — all 15 or younger — were inside the stolen Kia. Police say no adults were present.

Because the alleged driver is only 13, former Montgomery County prosecutor Mark Anderson says any charges — potentially including auto theft and vehicular manslaughter — would remain in juvenile court, with no ability to prosecute him as an adult.

Payne leaves behind his wife and five children.
